Our neighbor’s tree fell on our roof- isn’t her home insurance responsible for the damages?

When it comes to homeowners insurance and dwelling claims the way it typically works is: Your Property, Your Policy.

Unlike auto insurance, there is no at-fault party in a homeowners insurance claim of this sort. Since your home suffered the damage, it would be your claim to file with your own homeowners insurance company.  Whether or not the claim itself is covered depends on the peril involved.  Did wind or hail damage the tree and send it into your roof? Was the tree rotted and threatening your roof for an extended period of time? All of these things are taken into consideration.

Since homeowners insurance coverage can vary from one policy to the next, it is best to inquire with your home insurance agent about your specific coverage.

In the future, don’t hesitate to ask your neighbors to trim, or let you trim, any tree branches or other debris that may be threatening your home.
